Nkabinde Enquiry Refuses To Admit Advocate Shamila Batohi’s Written Submissions

Pretoria – The Panel of the Nkabinde Enquiry into the Fitness of Advocate Andrew Chauke to Hold the Office of Director of Public Prosecutions has declined the request by Advocate Shamila Batohi to admit her written submissions into the record.

Advocate Batohi had petitioned the Panel for leave to file formal written submissions to be admitted into the official record of the Enquiry.

The application sought to provide further context to her uncompleted cross-examination and her subsequent decision to discontinue oral testimony before the Panel.

However, today, Friday 12 June 2026, the Panel announced that it declined the request.

“Following a careful evaluation of the application, the answering affidavits, and the applicable legal framework governing these proceedings, the Panel has denied the application and declined to grant leave for the written submissions to be admitted into the record,” the Panel said.

“The detailed legal reasoning, structural rules of evidence, and parameters of procedural fairness informing this outcome are fully detailed in the actual ruling document made available alongside this media statement.”

Further to the ruling, the Panel said the Nkabinde Enquiry remains committed to its independent, fact-finding mandate established under Section 12(6) of the National Prosecuting Authority Act 32 of 1998.  

The Panel said it continues with its work of compiling its final report in accordance with its commitment to meet the prescribed timelines for submission to the President.
